2. Provo man charged in Box Elder County with enticing a minor
BOX ELDER COUNTY, Utah — A 39-year-old Provo man is in custody and faces multiple felony charges in northern Utah after prosecutors accused him of using electronic devices to entice a minor into illegal sexual activity, according to court documents filed Monday.
Russell Cory Nielsen was charged Oct. 26 in Brigham City's 1st District Court with two counts of enticing a minor involving first-degree felony sexual activity, each classified as a second-degree felony under state law.
The charges stem from separate alleged incidents occurring in Box Elder County between Sept. 30 and Oct. 1, according to the criminal information filed by the Box Elder County Attorney’s Office. The case was brought following an investigation led by the Perry Police Department, the filing states.
Nielsen was identified in court records as being in custody as of the date of filing. The charging information did not provide specific details regarding whether the communications involved a child or an undercover investigator posing as a minor.
Under Utah sentencing guidelines, a conviction on a second-degree felony can carry a statutory prison sentence of one to 15 years and fines of up to $10,000 per count. An initial court date has been set for November 2.

3. Perry Police investigation results in felonies for enticing a minor
A 39-year-old Provo man is facing 13 criminal charges after a Perry City Police Department investigation into allegations of inappropriate conduct involving teenage girls led to an undercover operation.
Russell Cory Nielsen faces six second-degree felony counts of enticing a minor to engage in first-degree felony sexual activity, five class A misdemeanor counts of enticing a minor, one class B misdemeanor count of enticing a minor and one third-degree felony count of obstruction of justice.
Charges are allegations, and Nielsen is innocent unless proven guilty in court. He was arrested Oct. 22 and is being held without bail.
According to a probable cause affidavit filed by PCPD, the investigation began Sept. 21, when the department received a child abuse and neglect report from the Utah Division of Child and Family Services concerning two teenage girls who participated in a production at the Heritage Theatre in Perry during May and June.
The report alleged that Nielsen, an adult involved in the production, made inappropriate sexual comments toward the girls and repeatedly touched their backs and waists.
Investigators contacted the girls' parents and arranged for one of the teenagers, who was 15 at the time of the production, to participate in a forensic interview at the Weber County Children's Justice Center.
During the interview, the teenager reportedly described several encounters that made her uncomfortable, including Nielsen asking whether she had ever sent "sexy pictures" to anyone and telling sexual stories.
The girl also reported that Nielsen frequently placed his hand on her lower back as she walked past him during rehearsals and performances. According to the affidavit, she eventually began taking different routes through the theater to avoid the contact.
The teenager told investigators Nielsen generally made the comments when other adults were not present.
She also described an occasion when Nielsen invited her and another teenage girl to his home for what she believed was a gathering involving the theater cast. When they arrived, however, they discovered they were the only two cast members invited, according to the affidavit.
Following the interview, an officer obtained permission from the girl's parents to conduct an undercover investigation by impersonating her through text messages.
According to the affidavit, the conversation initially focused on theater, school and Nielsen's interest in drawing. Nielsen discussed creating nude figure drawings and offered to draw the teenager, asking her to send photographs of herself.
The conversation became increasingly sexual, according to investigators. In one exchange, Nielsen reportedly told the person he believed to be the teenager, "you have a very rare kind of beauty that neither of us see often."
After discussing the girl's appearance, Nielsen asked her to send additional photographs, including pictures taken while bathing.
At another point, Nielsen acknowledged the girl's age while discussing his sexual thoughts.
"You realize you're asking me to tell you, a 16 year old girl, dirty thoughts? That's what you want?" Nielsen wrote, according to the affidavit.
After the undercover officer encouraged him to continue, Nielsen allegedly sent an explicit description of sexual acts he had imagined involving the teenager. He concluded the message by writing, "Now please delete this."
Investigators said Nielsen subsequently suggested moving the conversation to Snapchat, where messages could automatically disappear. The conversation continued on another messaging application.
According to the affidavit, Nielsen repeatedly requested nude photographs and sexually explicit images from the person he believed was the teenager. The undercover investigator documented six separate instances in which Nielsen allegedly requested child sexual abuse material.
The affidavit states that Nielsen also described sexual fantasies involving the teenager and acknowledged that some of the activities he discussed were illegal or socially unacceptable.
Investigators obtained a search warrant for Nielsen's residence and executed it Oct. 22.
While traveling to the residence, the undercover investigator noticed that earlier messages on the application had been deleted, according to the affidavit. Nielsen continued communicating with the undercover officer, again requesting nude photographs.
Police took Nielsen into custody after serving the search warrant, and he initially denied having a sexual interest in minors and claimed he had only communicated with the teenager through text messages.
During a subsequent interview at the police department, the undercover investigator informed Nielsen that he had been communicating with an undercover officer rather than the teenage girl.
"At this time Russell's jaw dropped, he sighed heavily and started to obviously panic," the investigator wrote in the affidavit.
After learning about the undercover operation, Nielsen allegedly admitted to having a sexual interest in children and acknowledged making the statements documented in the investigation.
According to the affidavit, Nielsen told investigators he had viewed, used and downloaded child sexual abuse material for at least a decade, including images and videos depicting young children and teenagers.
Nielsen reportedly told investigators they would likely find such material on his electronic devices, though the affidavit does not establish whether investigators later recovered it.
Nielsen's initial appearance is scheduled for Nov. 2, at the Brigham City District Court.
