Todd Alan Tanner (AKA Todd Allen Tanner) was a Mormon church member in Colorado and St. George, Utah and co-founder of Swig, the customizable dirty soda shop.
Swig opened for business on April 2, 2010, according to a January 2025 KSL article.
In 2014, the St. George Chamber of Commerce honored Tanner and a Swig co-founder with the Startup Business of the Year Award.
2010-2011: Todd Tanner child sexual abuse case
In February 2010, Tanner was charged in Colorado after alleged grooming and repeated sexual assault of a young girl.
Tanner was initially charged with four felony counts related to child sexual abuse, one misdemeanor count of sexual contact with no consent, and one misdemeanor count of harassment.
The victim came forward as an adult and reported abuse that allegedly began in June 2000, when she was 12 years old.
The alleged abuse went on for about three years, until the victim was 15.
In June 2011, Tanner pleaded guilty to one count of attempted sexual assault on a child, and one misdemeanor count of sexual contact with no consent.
Tanner was sentenced to 48 months probation. Thanks to a plea agreement, a 48-month jail sentence was deferred.
2010-2014: Todd Tanner’s work at Swig in St. George, Utah
In a 2014 St. George Spectrum article, Tanner’s Swig co-founder said, “We just wanted our dream to work — especially since we started at the height of the economic crash […] When we first started, [Todd] would be the only one there. He’d open at 7:30 (a.m.) and be there until 11 (p.m.). It was after the first three or four months that it finally started to go.”
Floodlit is not aware when Tanner stopped working at Swig or whether he retained any ownership in the company after it was acquired by Four Foods Group in 2017.
Floodlit obtained documents from a 2015 civil lawsuit filed by Swig in Utah’s federal court against a competitor. In December 2016, Tanner and his co-founder were scheduled for depositions, which the court then ordered to be rescheduled. The suit was dismissed with prejudice in 2017 after settlement negotiations.

Todd Tanner’s history in the LDS church
Tanner grew up in southwestern Colorado and moved to St. George, Utah in late 2009.
In the 1990s and 2000s, Tanner may have been a member of the LDS Durango Colorado Stake and one of three Cortez wards in the area, according to Floodlit’s research.
While living in Colorado, Tanner may have been a stake high council member; Floodlit is seeking more information on that.
A person who knew Tanner told Floodlit that Tanner was their Sunday School teacher in St. George, Utah in around 2011 to 2013, when they were a teenager.
At the time, Tanner had been convicted in Colorado of crimes related to child sex abuse, but the person said they were not aware that Tanner was a convicted and registered sex offender.

1. Man gets sentence in child sex case
A child molestation case more than a decade old came to a conclusion Wednesday with the sentencing of 41-year-old Todd Allen Tanner.
Tanner entered an agreement with the 22nd Judicial District Attorneys Office and pleaded guilty to attempted sexual assault on a child and unlawful sexual contact pertaining to acts with a then 12-year-old girl beginning in June 2000.
Now a grown woman, the victim spoke at Wednesdays hearing, saying the abuse began as small acts and led to darkness in her life.
All I wanted was to go far away to a place where you could not hurt me, she told the defendant. Now I speak for the 12-year-old girl I once was.
The victim alleged Tanner manipulated and deceived those around him about the sexual abuse and his substance abuse. She said through the abuse, the man took away her ability to love and trust those around her.
You changed how I feel about myself, she said. You dont deserve that kind of power.
She said she will have to challenge the monsters inside her head to live a normal life.
It seems so far away, she said. Many days, it seems I feel ready to give up. ... I continually uncover the hidden wounds that will need to be healed.
Through the help of family and friends, the victim said she is able to release the darkness, guilt, shame, anger, dread and distrust of men.
I choose to take back my power and relinquish the power he held over me, she said.
She asked Chief Judge Douglas Walker for the maximum sentence under the plea agreement
Tanner said little at the hearing. His attorney, Alex Tejada said his client is deathly afraid of whats going on.
Tanner apologized for his actions.
I claim responsibility for my actions, he said.
After months of negotiations with the district attorneys office, Tejada said they were able to agree on the unlawful sexual contact charge, which would require Tanner to register as a sex offender.
The prosecution is intent on having something that reflects a sex offense, Tejada said.
Walker accepted the offer, sentencing Tanner to a 48-month deferred sentence and 48 months of concurrent probation.
Tanner will serve no jail time unless he violates the conditions of his probation, at which point he could serve up to six years in prison, with two years parole and a $100,000 fine.
The terms of probation require Tanner to register as a sex offender, seek sex offender treatment, provide a DNA sample for a criminal database, substance abuse testing, substance abuse treatment, attendance at Alcoholics Anonymous, payment of $5,867 in court costs, payment of restitution to the victim, and adherence to a protective order requiring no contact with the victim or witnesses.
Walker told Tanner he had received a relatively light sentence and hinted he would not be so lenient if the defendant violated the terms of his probation.
The fact that this case has been drawn out for so long worked in your favor, Walker said, because I wanted to end this for the victim.

2. St. George business leaders receive honors
ST. GEORGE – When Swig opened on a street corner north of Dixie State University in early 2010, the soda shack attracted little notice in the community at large.
But as daily lines of cars began to stretch out of the parking lot and around the corner, it was hard not to notice that the business’s concept of mixing sodas and smoothies according to personalized demand was becoming something of a cultural phenomenon.
During the past year, Swig owners Todd and [redacted] Tanner have added three more locations and close to 100 employees, and on Saturday they were honored by the St. George Chamber of Commerce with the Startup Business of the Year Award.
“We knew there were other people out there like us who just love a good drive-through drink,” [redacted] said.
“We just wanted our dream to work — especially since we started at the height of the economic crash,” she said. “When we first started, [Todd] would be the only one there. [redacted] said the company hopes its opening near Brigham Young University in Provo will be followed by another six Swigs in Northern Utah this year, but the rest won’t rely on university crowds to propel their business.
“We cater to everybody, but I would say most of our business is drive-through moms who don’t have to get their kids out of the car,” she said.
The chamber’s annual “Starry Nights” awards banquet recognizes seven business representatives who exemplify the success and quality of the Southern Utah business community, Chamber event coordinator Susi Lafaele said.

3. Our Story
Swig got its start in 2010 in Saint George, Utah. Owner and Founder [redacted] Tanner was brainstorming with [Todd Tanner] one night about possible business ideas. He suggested a drive-by drink shop, something they both agreed could be successful. They opened their first location across the street from Dixie State University in April of 2010.
“We knew that there was a need for a good, fun drive-thru, and we knew that there were other people out there, like us, that enjoyed a good fountain drink,” says Tanner.
And the name? It was inspired by a single question when [Todd Tanner] simply asked, “CAN I HAVE A SWIG OF YOUR DRINK?”

4. How [redacted] Tanner founded Swig
Years later, [Todd] [...] moved [...] to St. George in the fall of 2009.

After we got our landlord on board, we fixed up the building and opened the first Swig on April 2nd, 2010. We served $1 drinks for the first couple of months just to get people to try us, and within the first six months, things really started to take off. By the end of the first year, we had lines wrapping around the corner—that’s when we realized that this crazy idea was actually working.

Toward the end of year two, we decided to open another location in St. George. We found a location only a mile from our first store, an older building that also needed a lot of work. We fixed it up, painted the building, and opened the second Swig location in March 2013.

5. In 2010, the 'Dirty Soda' revolution was born, but Swig is 'just getting started'
ST. GEORGE — On April 2, 2010, [redacted] Tanner opened a soda shop business in a small building in St. George, hoping to attract customers to a new way of getting their soda fix.
On that day, Swig was born. The operation was simple at first, with Tanner selling basic Coke and Pepsi products before the "Dirty Soda" was added to the menu.
"I really believed that once they tried it, and they felt that Swig experience and felt valued in our line, they would keep wanting to come back and get their drink fix from us," founder [redacted] Tanner said.
Along with a great product, Tanner wanted a "fast-moving line with amazing customer service."
Now, 14 years later, Swig has 104 soda shops across 14 different states, with a goal to have at least 1,000 locations throughout the country by 2030.
"As good as the last 14 years have been, the next 10, 14, 20 is going to be even better, because we're really just getting started," Tanner said.
"Swig is a category creator, and it's not often that you get to be a part of something like that," said David Smith, Managing Partner at Larry H. Miller Company. "[redacted] created a whole category of premium, customizable soft drinks."

6. The Origins of Dirty Soda: From Mormonism to Mainstream
Dirty Soda has its origin in Utah with the Mormon faith, but it has exploded into popularity within the last decade. The history of this type of drink is an interesting one. From Mormonism to mainstream, here is the history of dirty soda.
What is dirty soda?Dirty sodas are made up of soda, creamers and flavoring syrups. There are several different places that are selling drinks that are customizable. The modern day popularity of them began in 2021 on TikTok where the idea exploded. However, TikTok did not come up with this trend; the origin of a dirty soda dates back to the early 2010s in Utah, but there is evidence of other dirty sodas even earlier than that.
The history of dirty soda
The history of dirty soda links back to The Church of Jesus Christ of Latter-day Saints. According to the Word of Wisdom, which is of revelation in the Doctrine and Covenants, Prophet Joseph Smith found that “hot drinks” are not right for the belly and the body, meaning drinks like coffee and tea were off limits.
Later, Mormon leaders extended this to other caffeine like cold coffees and teas. It is hotly debated within Mormon leader spaces if this rule includes all caffeine. According to a newsletter put out by the church in 2012, it specifies that the “hot drinks” rule only applies to varieties of coffee and tea and not caffeine.
There have been earlier ways of getting around this rule that predates dirty soda. Egg creams, Coke floats, and even Pepsi and milk are all examples of drinks that predate dirty soda.
Swig
One of the most popular drive-thru dirty soda shops is a company called Swig. Swig was founded in 2010 by [redacted] Tanner, a Mormon mother of five who started the business as a means to fill a gap in the community. She opened the first location in Saint George, Utah, across from Dixie State University. The reason that Tanner chose to do a drive-thru soda shop is because it was a niche that was not tapped into yet.
From there, Swig as a company exploded in popularity all over Utah but had not picked up speed nationally until about 2021 when singer-songwriter Olivia Rodrigo posted an advertisement with them on their Instagram, showing off a cup of her own. Later in an interview, Rodrigo explained that she had lived in Utah for a while and enjoyed Swig growing up. After this, the company blew up and started moving to other states. Now they have locations in Florida, North Dakota, South Dakota, Idaho, Tennessee, Arkansas and Missouri.
Unfortunately, there is not a Swig location in Ohio yet. The closest Swig to Wright State University is in Louisville, KY. But there are other restaurants that followed in the footsteps of Swig that also sell these drinks.
Sonic Drive-In, the drive-thru chain restaurant came out with their dirty soda menu in 2023 that allowed any soda that they sell to be customizable. The closest Sonic to campus is on Colonel Glenn Highway. Another popular place to get dirty sodas is Buc-ee's gas station. One of the things that Buc-ee's prides themselves on is having enough syrups to be able to concoct dirty soda.
Currently there is not a Buc-ee's in Ohio but there is one being built in Huber Heights that is scheduled to open Spring 2026. Another option is to go to Speedway and use their syrups that they have for their coffee. The closest Speedway is right across from the Nutter Center on Colonel Glenn Highway.
RecipesFor the students that do drink dirty sodas, they always have their favorite recipe that they get every time.
“I always get a Dr Pepper, and then I put vanilla syrup in it. Then I'll put a cut up lime and a few cherries and a little bit of cherry juice in it,” Nursing Student Hannah Layton said. “It's so good, sometimes I'll go to Sonic before class to grab one just so I have one."
Dr Pepper as a company has lent themselves to getting in on the dirty soda craze, partnering with Coffee mate to make a coconut lime creamer to specifically have with coffee.
“I like to get a Shirley Temple every now and then,” Fairborn Resident Crystal Hendrick said.
The Shirley Temple has origins dating back to the actress herself. Shirley temples were created due to the need for there to be a non-alcoholic drink for the actress to perform in bars.
The recipe calls for either Sprite or 7Up mixed with a red grenadine. It is debated whether or not a Shirley Temple is considered a mocktail (mock cocktail) or a dirty soda. While creamer is usually a major aspect of dirty sodas, which a Shirley Temple does not come with, some argue that a dirty soda does not need cream or creamer.
Another recipe that is good is orange Fanta with a splash of vanilla creamer in it. It is made to mimic the taste of an orange Dreamsicle and is very good.
There are many different other combinations that you could do with your soda, but one thing is for sure: this is a trend that will not go away for a while.

Swig is a drive-through soda-fountain chain primarily located in the western United States. The chain, known for its popular "dirty sodas", was founded in April 2010 by [redacted] and Todd Tanner in St. George, Utah. Since then, Swig has experienced steady growth and, as of June 2025, operates locations in fifteen states. Swig's majority owner is Larry H. Miller Company (LHM), with the Savory Fund having a minority interest.
History
Inspired by childhood memories of grabbing cold Cokes from her grandparents' fridge, [redacted] Tanner and [...] Todd Tanner founded Swig in 2010 as a drive-thru specialty soda chain. Her first location, a small 700-square-foot space across from Utah Tech University in St George, Utah, initially charged just $1 to entice customers to try the unique twist on soda.
Swig quickly caught on with the local community and became a go-to spot, serving as a tempting substitute for potential vices. As other soda shops began popping up around Utah with similar offerings, Swig trademarked the term "dirty soda" in 2013, solidifying its status as the pioneer of the burgeoning specialty beverage segment.
Savory Fund took a majority stake in the business in 2017. The partnership fueled a period of growth, with Swig expanding its footprint to 40 locations within five years.

In 2015, Swig sued competitor Sodalicious over their use of the term "dirty soda", which Swig stated it had trademarked in 2013. Sodalicious argued that the term was generic and thus could not be trademarked.[6] The lawsuit ended with an undisclosed settlement in 2017.
By 2017, Swig had 16 locations and more franchise offers from outside of Utah. The same year, [redacted] Tanner sold the chain to the restaurant management firm Four Foods Group. As of 2018, the company headquarters is located in Lehi, Utah.

2. Date, Time, Reporting Officer: On 08/27/2025, at approximately 0230 hours,
Probable Cause Statement:
I responded to the residence of [REDACTED] to conduct a sex offender compliance check with Todd
Tanner which included a charge from Colorado of Sexual Contact No Consent (Minor). Upon arrival, I met with
Todd at the front door and he allowed me inside his residence to go over the sex offender information form. As
we were going through the form, I asked Todd if the Side-by-Side outside belonged to him to which he told me
it did. Todd said the Side-by-Side was at his ex-wives house however he has owned it since 2018-2019 and
has been on the the sex offender registration since 2011 but never knew he need to put his Side-by-Side on
the registration. Todd said he got the side-by-side back from his ex-wives house a few months ago and had
even completed a new registration on 08/26/2025 but still had no idea he needed to put it on his sex offender
registration form. I took Todd into custody for the sex offender registration violation. As we were walking to my
patrol vehicle Todd asked me to grab his fanny pack out of his truck that contained his drivers license. When I
looked at his drivers license it had an address of [REDACTED] St George, Utah 84790, which is different

then his current residence of [REDACTED] Todd criminal history showed he was convicted of misdemeanor
sexual contact no consent out of Colorado.
