On December 23, 2025 Berndt was driving while OPERATE VEH W/O LICENSE OR REGIST (SUSPENDED OR REVOKED) – Class C Misdemeanor.  This appears to have been a violation of his probation from his Feb. 2022 attempted sexual abuse 1st degree felony / plead guilty case.  As of January 23, 2026, he is incarcerated in the Davis County Jail, according to the Utah Department of Corrections.

In July 2017, Berndt, then 19, was charged with:

– UNLAW SEX ACTIVITY WITH A MINOR – Class B Misdemeanor and the plea was held in abeyance for a period of 12 months.  This means that even though Berndt pleaded guilty, he ultimately was not convicted.  He complied with the terms of the plea agreement, and the court dismissed the charge of unlawful sexual activity with a minor.
