Couple facing allegations of perjury
After a Cody man was arrested on charges of sexually abusing a minor, authorities say his wife attempted to help him by destroying or hiding potential evidence. The woman is now facing her own, lesser charges.
James “Jimmy” Parks, 49, was taken into custody last month on three felony counts that allege he sexually abused a teenager over the past two years. He formally denied those charges on Wednesday, pleading not guilty during an appearance in Park County District Court.
However, the proceedings became more complicated this week, as prosecutors filed new charges against both Jimmy Parks and his wife, 37-year-old Amanda D. Parks.
Among other contentions, the Park County Prosecuting Attorney’s Office alleges that Amanda Parks erased all of the data on her husband’s cellphone and conspired to hide or destroy surveillance camera footage in the days after his arrest. She faces three misdemeanor counts that allege she served as or conspired to serve as an “accessory after the fact” to Jimmy Parks’ alleged crimes.
The county attorney’s office is also pursuing felony counts of perjury against both Parkses, alleging the couple gave false testimony to a judge last month when applying for court-appointed attorneys.
Arguing bond
Jimmy Parks has remained in custody since his arrest last month and his bail now stands at a combined total of $210,000 cash. A defense attorney argued in District Court on Wednesday that Jimmy Parks’ bail is “excessive” but, at least for the time being, Judge Bill Simpson declined to lower it.
Meanwhile, after being arrested on Monday, Amanda Parks was released on a $15,000 surety bond on Tuesday afternoon.
Prosecutors had asked Park County Circuit Court Judge Joey Darrah to set Amanda Parks’ bail at $30,000 cash only, but Darrah cited the potential impact on the couple’s children — who were recently taken into foster care — in setting a lower figure.
At the Tuesday hearing, Amanda Parks described herself as the only one able to take care of the couple’s affairs and children while her husband is jailed.
“We’ve had to sell our business. We’ve had to sell everything,” she said, adding, “even though we’re supposedly [presumed to be] innocent, our lives are being destroyed in all of this.”
For her part, Deputy Park County Prosecuting Attorney Marina Tucker argued that the allegations were “very serious” and that there’s “strong evidence” Amanda Parks conspired with her husband after his arrest.
“The state finds Ms. Park’s actions to be particularly troubling and heinous, given that there is no reason to destroy evidence if Ms. Parks did not believe that there was a basis for the allegations against Mr. Parks,” Tucker argued in part.
At Wednesday’s hearing in district court, the prosecutor further contended that authorities have “substantial evidence” against Jimmy Parks, including the recovery of semen from a location where abuse allegedly occurred.
Tucker did not offer any details, and “without the context of witness testimony, etc., that in and of itself, … we would not consider substantial evidence,” countered Sam Krone, one of Jimmy Parks’ defense attorneys.
Follow-up investigation
Jimmy Parks’ original Oct. 17 arrest was based almost exclusively on the account that the alleged victim provided to law enforcement. According to charging documents, the teen told the Park County Sheriff’s Office that Jimmy Parks had shown him pornography and engaged with him in masturbation and oral sex.
As part of their follow-up investigation, the sheriff’s office and Cody Police Department obtained search warrants for Jimmy Parks’ vehicle, business and home, but they initially could not find Parks’ cellphone.
During an Oct. 23 search of the Parks’ residence, a sheriff’s deputy tried calling Jimmy Parks’ cell number and Amanda reportedly answered. She allegedly said she had just picked the phone up from Jimmy Parks’ office and turned the device over to police, charging documents say.
However, when Cody Police Det. Tyler Eubanks later examined the Samsung Galaxy S23 Ultra, he says he found the phone had been manually “wiped” of its data while the officers were searching the Parks’ home.
“This reset occurred after Amanda Parks had been informed the cell phone was to be seized through a lawful warrant and before she provided it to law enforcement,” Eubanks wrote in an affidavit, adding that it appeared she restarted the device and set up a new passcode.
Authorities were also interested in surveillance camera footage from PC Cowboys — the Parks’ since-sold business — but did not find it in their search, charging documents say.
A PC Cowboys employee reportedly told police that the footage may have been saved on a solid-state hard drive that Jimmy Parks had told him to remove and give to Amanda.
Eubanks later listened to an Oct. 21 jail call between Amanda and Jimmy Parks in which Jimmy reportedly asked his wife if she’d stopped by PC Cowboys and seen the employee.
When Amanda said she had, Jimmy Parks reportedly said, “that thing can probably just get, umm, like, I know [another person] likes to break things into little tiny pieces, OK?”
“Yup,” Amanda allegedly replied.
Det. Eubanks interpreted that to mean the couple conspired to destroy the solid-state drive — though he acknowledged its whereabouts and actual contents “are unknown.”
Future proceedings
Additionally, Jimmy Parks is facing two counts of perjury and Amanda Parks one for statements they reportedly made to Judge Simpson last month.
One of Jimmy Parks’ charges alleges that he falsely told the court that he didn’t have a cellphone while the others allege the couple didn’t disclose all of their assets to Simpson when they requested court-appointed attorneys in a separate, confidential proceeding.
The couple has reportedly retained private counsel for their criminal cases.
In requesting a reduced bond for Jimmy Parks on Wednesday, Krone said it was important to note that his client “has no previous criminal history, has no failures to appear [in court] ... has longstanding ties to the community, owns property in the community, is an active member of his church in the community, business owner in the community.”
While acknowledging the allegations are “very serious,” Krone noted that his client is presumed to be innocent and said any concerns could be mitigated with bond conditions.
Simpson declined the defense’s request to lower bail to $100,000 cash or surety, but said he’d be willing to reconsider bond at a future hearing.
A trial for Jimmy Parks will be scheduled in district court within the next six months on the sex crime charges, while both Parks are set for preliminary hearings in circuit court next week on the new perjury and accessory charges.
