  POCATELLO – Che Tayen Miles, 39, of Idaho Falls, was sentenced to federal prison for receipt of child pornography, U.S. Attorney Josh Hurwit announced. Chief U.S. District Judge David C. Nye sentenced Miles to 136 months in federal prison followed by 8 years of supervised release.

  According to court records, between July and Sept. of 2022, the Idaho Internet Crimes Against Children (ICAC) Task Force found that Nathan Mark Law, 49, of Idaho Falls, had downloaded thousands of images of child pornography also known as, “child sexual abuse material” (CSAM) over the internet.

  Investigators executed a search warrant of Law’s residence where they discovered CSAM on Law’s electronic devices. Law admitted he downloaded and uploaded images of CSAM and shared CSAM images with Miles.

  On Dec. 21, 2022, investigators executed a search warrant at Miles’s residence and seized his electronic devices. Miles admitted he downloaded CSAM and that he received CSAM from Law. Upon searching Miles’s electronic devices investigators discovered thousands of CSAM images that Miles downloaded from the internet as well as CSAM images that Miles received from Law.

  On June 26, Law pleaded guilty to attempted sexual exploitation of a minor child. He is scheduled to be sentenced by Chief Judge Nye on Oct. 8, and faces a minimum of 15 and up to 30 years in federal prison and up to a lifetime of supervised release.

  “We are grateful that justice will be served in these cases. But our collaborative work to guard Idaho’s children continues,” said U.S. Attorney Hurwit. “Together with our local, state, and federal law enforcement partners, my office is committed to tracking down and aggressively pursue anyone in Idaho who creates, possesses, or shares child pornography.”

  “This sentence is appropriate for someone who perpetuated child victimization by downloading and sharing thousands of images of exploited children,” said Special Agent in Charge (SAC) Robert Hammer, who oversees HSI operations in the Pacific Northwest. “HSI partnerships with the ICAC Taskforce and Idaho law enforcement are integral in keeping our communities safe from child predators.”

  These cases were investigated by the Idaho ICAC Task Force, Homeland Security Investigations, the Idaho Falls Police Department, and the Bonneville County Sheriff’s Office. Assistant U.S. Attorney Justin Paskett is prosecuting these cases.

  The Idaho Crimes Against Children Task Force arrested a man in Bonneville County on Wednesday for possession of child pornography.

  The Idaho Attorney General’s Office announced the arrest of Che Miles, 39, in a news release. The task force, which is made up of local law enforcement officers in Idaho, was assisted by the Bonneville County Sheriff’s Office, Idaho Falls Police Department and Bonneville County Prosecutor’s Office.

  A case has not been filed against Miles as of Wednesday evening. Possession of sexually exploitative material depicting a child is punishable with up to 10 years in prison.

  Before the Court is a Report and Recommendation filed by the United States Magistrate Judge. Dkt. 25. On April 11, 2023, Defendant, Che Tayen Miles appeared before the Magistrate Judge to enter a change of plea pursuant to a written plea agreement. The Magistrate Judge conducted the plea hearing and concluded there is a factual basis for Defendant's plea of guilty to the charges contained in Count One of the Indictment (Dkt. 1), and that it was entered voluntarily and with full knowledge of the consequences. No objections to the Report and Recommendation have been filed.

  The Court now has reviewed the record, and find that the requirements of Rule 11 have been met. See United States v. Reyna-Tapia, 328 F.3d 1114 (9th Cir. 2003). Specifically, the Court finds that the Magistrate Judge adhered to the requirements of Rule 11(b); that under Rule 11(b)(2), the Defendant's plea was voluntary and not the result of force or threats or promises apart from the plea agreement; and that a factual basis for the plea exists. See id. Accordingly, IT IS HEREBY ORDERED that the Report and Recommendation (Dkt. 25) shall be, and the same is hereby, ADOPTED as the decision of the District Court and incorporated fully herein by reference.

  IT IS FURTHER ORDERED that the Defendant's plea of guilty to the crimes charged in Count One of the Indictment (Dkt. 1), shall be, and the same is hereby, ACCEPTED by the Court as a knowing and voluntary plea supported by an independent basis in fact containing each of the essential elements of the offense.

  IT IS FURTHER ORDERED that the Defendant, Che Tayen Miles is found to be GUILTY as to the applicable crimes charged in the Indictment. Dkt. 1.

  REPORT AND
  RECOMMENDATION
  On April 11, 2023, Defendant Che Tayen Miles appeared before the undersigned
  United States Magistrate Judge to enter a change of plea pursuant to a written plea
  agreement. (Dkt. 19). The Defendant executed a waiver of the right to have the
  presiding United States District Judge take his change of plea. Thereafter, the Court
  explained to the Defendant the nature of the charges contained in the Indictment (Dkt. 1),
  the maximum penalties applicable, his Constitutional rights, the impact that the
  Sentencing Guidelines will have, and that the District Judge will not be bound by the
  agreement of the parties as to the penalty to be imposed.
  The Court, having conducted the change of plea hearing and having inquired of
  the Defendant, counsel, and the government, finds there is a factual basis for the
  Defendant’s guilty plea, that he entered it voluntarily and with full knowledge of the
  consequences, and that the plea should be accepted. The undersigned also ordered a pre-
  sentence investigation to be conducted and a report prepared by the United States

  RECOMMENDATION
  NOW THEREFORE IT IS HEREBY RECOMMENDED:

  2) The District Court order forfeiture consistent with Defendant Che Tayen
  Miles’s admission to the Criminal Forfeiture allegation in the Indictment (Dkt. 1) and the
  Plea Agreement (Dkt. 19).
  3) The District Court GRANT, at the appropriate time, the United States’
  motion to dismiss Count Two of the Indictment (Dkt. 1) as to Defendant.
  Written objections to this Report and Recommendation must be filed within
  fourteen (14) days pursuant to 28 U.S.C. § 636(b)(1) and Local Rule 72.1(b), or as a
  result of failing to do so, that party may waive the right to raise factual and/or legal
  objections to the United States Court of Appeals for the Ninth Circuit.
