This motion to dismiss, filed Aug. 10, 2024 by the defense in a Utah criminal case against Alan Brower Bassett, centers around an unsigned 1989 non-prosecution agreement.

The defense said that in 1989, the Davis County Attorney’s Office entered into an agreement with Alan Brower Bassett, promising not to prosecute him for “any of his sexual activities” between February 13, 1978, and May 1989, provided he met certain conditions (e.g., completing a treatment program, registering as a sex offender, paying for victims’ therapy).

in 2024, the state charged Bassett for child sexual abuse that allegedly took place within that timeframe, prompting the defense to argue a breach of contract.

Many women came forward during Bassett’s criminal proceedings, saying he molested them when they were girls.
