Case report

David Roy Phipps also known as David Roy Verity was a mormon and a dentist in Sacramento, California.  An accusation was filed in 1987 against Phipps, alleging sexual battery against six patients.  Phipps plead nolo contendere to two counts of misdemeanor sexual battery involving two of his patients and the dental licensing board put him on probation for 5 years.  The first year of probation he was not permitted to work on female patients.  The last 4 years of probation Phipps had to have a chair side assistant in the room with him. Phipps probation ended in April of 1994.

On April 5, 1994 while working on a patient who he used nitrous oxide on, Phipps sent his assistant out of the room and sexually assaulted the patient.  The chair side assistant saw it and sent in another assistant to keep an eye on Phipps.  Phipps once again sent the second chair side assistant out, who also then witnessed Phipps sexually assault the patient.  In June of 1994 the Dental Board started disciplinary proceedings against David Phipps.   December of 1994 Phipps/Verity had  a criminal complaint filed against him alleging a felony of sexual battery by restraint and sexual battery a misdemeanor.  The complaint also alleged that Phipps committed sexual battery against another patient that was known.  The case went to trial and Phipps plead nolo contendere to two counts of misdemeanor sexual battery.  David Phipps was sentenced to 365 days in jail.

In July of 1996 the Dental Board decided to revoke David Phipps dental license.  After released from jail David Phipps legally changed his name to David Verity.  The patient abused in April of 1994 was  awarded by the court a judgment against Phipps in the amount of $1,032,276 plus interest and costs, which later there was an appeal and cross-appeal in this case arise out of a judgment in the amount of $1,415,639.54 (plus costs) but due to breech of insurance contract.
