  SALT LAKE CITY, Utah (ABC4) – A Utah man was charged Thursday with sexually assaulting a woman he met on a dating app.

  Samuel Whitney Faber, 42, out of Sandy, was charged with first-degree felony aggravated sexual assault (three counts), first-degree felony aggravated kidnapping (one count), second-degree felony forcible sexual abuse (two counts), and third-degree felony aggravated assault (one count).

  According to an affidavit of probable cause, the victim met Faber on the Mutual dating app, which is meant for members of the LDS Church. The two reportedly chatted for a few days before meeting up on March 6.

  They met at a restaurant, the affidavit states, and the victim claims that Faber was “asking her weird questions,” like if she had a conceal carry weapon permit. Faber allegedly then told her that he had one, and took a .22 caliber gun, which “looked like a silver metal case that opened up into a firearm,” out of his pocket.

  They reportedly discussed cars before Faber invited the victim to come back to his house and see his new Camaro, to which she agreed.

  On the way back to his house, Faber allegedly asked the victim if her family knew where she was, before commenting, “If I threw you in a ditch, I would have to take your phone,” the affidavit states.

  Once back at the house, Faber gave the victim a tour of his house and backyard, and once again showed her his gun, pointing out “where the bullets go and where the extra bullets go,” before putting a bullet in the gun and then putting the gun back in his pocket.

  Faber reportedly then began making sexual advances on the victim, who repeatedly said “no” and resisted his attempts. Eventually, the victim agreed to Faber’s request to go into his hot tub because “she felt she could control the situation better outside,” the affidavit states.

  Once in the hot tub, Faber continued to sexually assault the victim. The affidavit states that they then exited the hot tub, and the victim asked Faber to take her back to her car.

  On the way back to her car, Faber reportedly put her purse behind his seat “where she could not reach it.” Instead of taking her back to her car, Faber allegedly stopped behind a building in an industrial area and forcibly sexually assaulted her.

  After the assault, Faber then drove the victim back to her car. Once free, the victim drove to the hospital for a sexual assault examination.

  According to the affidavit, Faber told police that “if he knew all of this was going to happen, he wouldn’t have pushed the limits.”

  SALT LAKE CITY — A Sandy man has pleaded guilty to sexually assaulting three women he met on dating apps.

  Samuel Whitney Faber, 43, was charged in three cases, with a total of three counts of aggravated sexual assault and aggravated kidnapping, eight counts of forcible sexual abuse and aggravated assault, tied to assaults involving three women since 2022.

  On May 31, Faber entered into a plea deal to resolve all three cases, pleading guilty to amended charges of rape and forcible sodomy, first-degree felonies; plus aggravated sexual assault and two counts of forcible sexual abuse, third-degree felonies. When he is sentenced Aug. 21, it is anticipated he'll be sent to the Utah State Prison for a term of five years to life, with many of his sentences running concurrent.

  Before entering into the plea agreement, one victim whom Faber admitted to raping, in addition to physically assaulting, told 3rd District Court Judge Richard McKelvie her only hesitation to agreeing to the plea deal was none of the amended charges include long mandatory sentences.

  "I'm not necessarily objecting to the plea. I just want it known that no amount of time will ever be enough. He strangled me and I had a stroke. And that has affected my work, my kids, my whole life, and that will never go away. I'm always going to have problems with that," she tearfully told the judge.

  The woman said her foot was also broken when she was assaulted. And she was so traumatized by the entire event that, for a long time, she wouldn't even leave her bedroom, out of fear.

  "This has ruined my life … and it's just something I have to live with forever. And any amount of time is never going to fix what happened to me. I'm always going to be broken. I am doing this because I think he will do this again. And I think I have to save the next one," she said. "I don't want him to do it again, and that's why I'm here."

  The woman met Faber on the Mutual dating app in March 2022. After meeting him at a restaurant, Faber began asking her "weird questions" and then took a gun out of his pocket, according to charging documents. He also talked, in a joking manner, about throwing her body into a ditch. Faber later assaulted the woman at both his house and in his car.

  The other two women who were victimized by Faber were also in the courtroom when he pleaded guilty. McKelvie says he doesn't want the plea deal to minimize the trauma they each endured, and he applauded the woman who addressed the court for her courage, telling her he hopes she will at least explore the possibility of forgiveness as a way to move on.

  "In my experience, both as a judge and as a human being, the principle of forgiveness is incredibly powerful. And to be clear about this, I am not a religious person, and I don't believe that forgiveness is a religious principle. It is an opportunity that all of us have that someone has done wrong to us and that only by the miracle of forgiveness can we move on from that," McKelvie said.

  Accepting Faber's plea deal was also McKelvie's last act as a state judge.

  "This is literally the last thing I'm going to do as a district court judge. My retirement is today," he told the courtroom.

  Faber will undergo a psychosexual evaluation before being sentenced. McKelvie will return as a senior court judge to oversee that hearing.

  SALT LAKE CITY — Kristy thought she had taken all the right precautions.

  She agreed to meet Samuel Whitney Faber at a restaurant after initially making contact with him on the dating app Mutual, a dating platform catering to single men and women who are members of The Church of Jesus Christ of Latter-day Saints. They had messaged each other several times over the course of a few days before actually meeting. When they finally met at a West Valley restaurant, Kristy says they spent a long time talking about his church mission.

  "The whole time I was talking to him, it was about going to church, it was about his mission which I found out after he pled guilty that he didn't even serve a mission. He made that all up. We had a whole half-hour to 45-minute conversation about his mission, and it never even happened," she said.

  Last month, Faber, 43, pleaded guilty to sexually assaulting and raping Kristy and sexually abusing two other women. He is scheduled to be sentenced on Aug. 21. But because of what he pleaded to, there will not be any minimum-mandatory prison sentences. Kristy expects he'll likely be paroled in a few years. To her, it's the latest blow in what has already been a long and difficult process.

  "What victims have to go through in this whole process is awful. And I don't blame the other women for not wanting to go through it. It's hard. To get to this point to where we are today has been two years," she said. "I feel like I was on trial."

  But now, Kristy, and Misti, who was also a victim of Faber, are speaking out to try and prevent other women from becoming sexual assault victims. They are also hoping to encourage any other women who may have already been victimized by Faber to come forward and report their cases to police.

  "No amount of time is going to fix me, because I'm already broken for the rest of my life. And my poor kids are already broken for the rest of their lives, and I can't fix that, which is the only reason I agreed to the stupid sentence that he got," Kristy told KSL.com in tears.

  "But I have to save other people. I know, I know he will do this again."

  'I was OK until I wasn't'

  Kristy went out with Faber on March 6, 2022. By the time the night was over, she had been physically and sexually assaulted at his Sandy house and again as Faber was driving her back to her car. In December 2022, he was charged in 3rd District Court with aggravated sexual assault, aggravated kidnapping and forcible sexual abuse.

  Misti met Faber on the Bumble dating app and in June 2022 agreed to meet him at his house. He inappropriately touched Misti several times. But because he did not rape her, Misti says she didn't call police because she didn't think her case would go anywhere.

  It wasn't until she heard about Kristy's story that she decided to come forward.

  "The only reason I ended up coming forward was because I saw her story on KSL months after he had been arrested," Misti said. "(I thought) if that will strengthen her case so that he goes to prison, then I have to do that. I still didn't think they would file charges in my case because he didn't rape me. … I was flabbergasted that charges were filed (in my case)."

  A third woman stepped forward a few months later. She also met Faber on Mutual and was sexually abused after agreeing to go to his residence to go swimming. Faber was charged with three more counts of forcible sexual abuse.

  On May 31, Faber entered into a plea deal to resolve all three cases, pleading guilty to amended charges of rape and forcible sodomy, first-degree felonies; plus aggravated sexual assault and two counts of forcible sexual abuse, third-degree felonies.

  Kristy, whose encounter was the most violent and who was the most seriously injured of the three women — she suffered a stroke months later that doctors told her could be attributed to Faber strangling her and damaging her carotid artery — says even though she wasn't in favor of the plea deal, it spared all three women from having to take the witness stand.

  "If we had gone to trial, they would have torn us apart on the stand. It's hard enough to go through and have to relive it over and over and over and over every couple of weeks, every month for years. So for our sanity, we agreed to do the plea deal. But I don't agree to the plea deal," she said.

  Since the case has been settled, the three women have been able to talk to each other in more detail about their experiences with Faber. What they discovered is that their experiences are very similar. Faber presented himself well. And after getting to know his dates, he would eventually invite the women back to his residence and try to convince them to get into his hot tub or swimming pool. Prosecutors noted in charging documents in Kristy's case that once Faber got her back to his house, "he was very aggressive and tried to persuade the victim to engage in sex acts and get into the hot tub."

  Kristy and Misti both thought they had taken the safety precautions they needed to as this wasn't their first experience in the dating world.

  "I did all of those things. Every single one of them. And it still happened," Kristy said. "There's nothing on (dating apps) that can protect you from someone being manipulative and lying flat out to you. Because he seemed so nice and so charming."

  In hindsight, Kristy says Faber said things when she met him at a restaurant that should have raised red flags, such as whether she had a conceal carry permit or if her family was able to track her on her phone.

  But in the moment, Misti, who says she has had similar conversations with other dates, said it all seemed like part of the ritual of getting to know someone.

  "It's the type of things you typically talk about. 'Do you vote for Biden? Do you vote for Trump? Do you like guns? Do you not like guns?' It's a normal conversation. But in hindsight, that could have been him assessing whether I'm a threat to him," she said. "In hindsight, it's a red flag. But when getting to know someone, it seems normal."

  But there were also little inappropriate comments of a sexual nature that Faber would make, Misti recalled.

  "Don't ignore those little red flags. If something makes your intuition go, 'Hmm, that was kind of weird.' Just trust it. Because you're far better off trusting it than finding out the hard way that you should have relied on your instinct," she said.

  "I knew not to get in his car. I knew. I knew better. But we talked for over an hour at the restaurant. He was nice, and we were laughing and we were having fun," Kristy added. "I was OK until I wasn't."

  Both women say whether a young person is using a dating app for the first time or using one after a divorce or separation, there are precautions every woman should take. The big one, they say, is not to end up in a situation where the woman finds herself alone with her date.

  "Do not go alone. Make sure people always know where you are. Do not go to their home," said Kristy, who also advised going on a double date, or at the very least having a friend sit in the same restaurant nearby and prearranging a "help" signal.

  Until both parties really get to know each other, both women suggest going on dates in the daytime, making sure a friend or family member knows where you are, and making sure you talk to the prospective date a few times before actually agreeing to meet them.

  Even while KSL.com was talking to Kristy in a public coffee shop, her mother walked into the business about 30 minutes into the interview. Kristy waved to her and told her everything was OK, and then acknowledged she had told her mother to enter the business after a half hour to check on her as a safety precaution.

  The women also advise to research their potential date on social media or public resources such as the Utah State Courts online system called Xchange, which allows people to look up criminal histories of others for a small fee.

  Hoping others will come forward

  Since their cases went to court, the women say they have been contacted by numerous other women who claim they are also victims of Faber but don't want to go through the legal process.

  "After hearing everyone else's stories, it was obvious that he does the same thing over and over and over and over. And he got away with it over and over and over because women don't come forward, because it's hard. It's horrible to tell the police. It's horrible to go through the rape kit at the hospital after you've just been raped, to be swabbed from head to toe, inside and out. It's horrible.

  "This is the hardest thing I've ever done, and it's the worst thing I've ever gone through," Kristy said.

  She recounted how bad she was shaking when she went to the courthouse and saw Faber for the first time after her assault, which caused her to throw up in the courtroom.

  Both Kristy and Misti say the court process itself becomes extremely difficult, not just because they have to continually relive what happened to them, but because of the constant delays that have become part of the process.

  But Kristy is hopeful now that Faber is about to be sentenced to prison that other women who may have been victimized by him will have the strength to contact police, which she hopes will result in additional criminal charges.

  Kristy gives a lot of praise to West Valley police detective Ray Wilhelm for investigating her case and taking the time to compile a strong case to present to the Salt Lake County District Attorney's Office for prosecution.

  "There's no way (Faber would) be in jail right now if the detective didn't do his work the way he did it," she said.

  West Valley police told KSL.com it is possible there are additional victims. And if anyone believes they were or know someone who was a victim of Faber, they are asked to call 801-840-4000.

  "It's important that women know that just because he didn't physically rape you, there are still felony charges that they will file," Misti said.

  Both women say they will be in the courtroom for Faber's sentencing. And then each time he has a hearing before the Utah Board of Pardons and Parole.

  "I want him to stay in there so much longer, and I don't know how to do it. But he's going to get out, and he will do it to someone else. And there's nothing that can stop that from happening unless you know where to go to check background information on somebody. I didn't know how to do that," Kristy said.

  SALT LAKE CITY — For two years, three women say they endured what seemed like a never-ending legal process.

  But on Wednesday, Kristy, Misti and a third woman got their day in court and addressed the man who sexually assaulted them after meeting them on a dating app. And they did not hold back their feelings.

  "You are a monster. My religion asks that we forgive. I don't feel this warrants forgiveness. Only God will give you forgiveness," Kristy said, directly addressing Samuel Whitney Faber. "You deserve everything that's coming to you. … You took away all the joy and happiness in my life."

  Kristy and Misti previously gave permission for KSL.com to use their first names in order to tell their stories.

  In June, Faber, 43, was convicted of rape, forcible sodomy and aggravated sexual assault against Kristy and attempted forcible sexual abuse against Misti and another woman as part of a plea deal. On Wednesday, he was sentenced to what works out to at least five years and up to life in prison.

  Before handing down the sentences, 3rd District Judge Coral Sanchez noted that consecutive sentences were warranted in this type of case. But due to the extensive effort made between prosecutors and Faber's defense attorneys to reach a plea deal, and the fact that the case's prior judge, Richard McKelvie who has since retired, agreed to it, she would honor the deal rather than risk Faber withdrawing his plea and having the entire process start over.

  For most of Thursday's 2½ hour sentencing, Faber sat expressionless, either staring straight ahead or with his head down, only occasionally looking up at the women speaking against him. All three of Faber's victims plus Kristy's mother, sister and two young daughters addressed the court.

  "I think you should go to jail for a thousand years. My mom cries nonstop because of you," one of Kristy's daughters said. "I hope you never get out of jail."

  "You probably don't know this, but hurting people like this is really bad," she continued.

  The girl, however, couldn't hold back her tears and had to have her mother finish reading the comments she had written down.

  "You did so many bad things in your life. Did you know my mom has to spend the rest of her life not being happy?" Kristy read from the note, which also stated that Faber should "go back to preschool" to learn that hurting people is bad.

  Faber's three victims and Kristy's mother had much stronger words for Faber, calling him a "monster" and referring several times to what they felt was narcissistic and arrogant behavior from someone who still doesn't believe he did anything wrong and who claims that the victims never gave him a hard "no" when declining his advances.

  Misti called Faber an "extremely dangerous, cold, calculating and manipulative man" who believes women are only there to satisfy his sexual desires.

  "You deserve to be locked away and forgotten, to be dehumanized the way you dehumanized me," she said, addressing Faber directly.

  Kristy's mother told the court that based on the similar accounts of abuse from the three women, she believes Faber had become very calculated in his pattern of abuse.

  "He knew what he was doing," she said.

  "I'm not happy with you. You have made me so angry," Kristy's mother continued, directly addressing Faber while also calling him an "arrogant, selfish jerk."

  Kristy, who refused to say Faber's name except for one time, said she reread her original statement to police in preparation for Wednesday's hearing and counted 83 times that she told Faber "no" on the night of her assault.

  "I don't know how he didn't know I said 'no' after 83 times," she said. "My life will never be the same. I will never be free to live my life without fear. … I believe this predator took my freedom to live my life.

  "This predator does not even show any remorse for what he did," Kristy continued.

  Even prosecutors noted that based on the presentencing report and multiple letters they had received from people who know Faber — including some members of his own family — Faber doesn't seem to understand the meaning of the word "no."

  "The defendant is a predator. His actions are deliberate," said Salt Lake County deputy district attorney Morgan Vedejs.

  "Mr Faber is an extreme risk to this community," added victim advocate Donna Kelly. "He has a side that he shows to the public. But he has another side. And that's the side he showed to the three women."

  Kelly says Faber wanted the women to consent to his sexual requests, "But he was going to proceed regardless."

  "He is a dangerous individual," she said. "He needs to be at the prison, and he needs to be there for a very long time."

  Faber's attorney, Adam Crayk, said despite what the presentence report indicates, Faber is sorry for what he has done and is not trying to minimize his accountability due to what he is and isn't pleading guilty to. He said that part is all the doing of attorneys working out a deal as part of the legal process. Crayk also reminded the court that any comments Faber made for the presentence report came from a man who has yet to undergo any sex offender treatment courses.

  When asked if had any words to the court prior to being sentenced, Faber called the entire process "humbling."

  "Words can't do justice. I'm sorry to the victims and the families," he said in a soft voice. "I'm sorry. I truly am sorry for what's happened. I'm trying to better myself and stay positive. I beg for their forgiveness and their remorse. And again, I'm sorry for my actions."

  Faber was originally charged with three counts of aggravated sexual assault and aggravated kidnapping, eight counts of forcible sexual abuse and aggravated assault. He pleaded guilty to amended charges of rape and forcible sodomy, first-degree felonies; plus aggravated sexual assault and two counts of forcible sexual abuse, third-degree felonies. He was sentenced to two concurrent terms of five years to life and a concurrent term of zero to five years, plus two consecutive terms of zero to five years in prison.
