CASE NUMBER 151500486 State Felony
CHARGES
Charge 1 - 76-5-404.1(4)(H) - ATTEMPTED - AGGRAVATED SEXUAL ABUSE OF CHILD-PERSON IN POSITION OF TRUST - 1st Degree Felony
Offense Date: August 28, 2015
Location: Iron County
Plea: November 29, 2016 Guilty
Disposition: November 29, 2016 GuiltySENTENCE PRISON
Based on the defendant's conviction of ATTEMPTED AGGRAVATED SEXUAL ABUSE OF CHILD-PERSON IN POSITION OF TRUST a 1stDegree Felony, the defendant is sentenced to an indeterminate term from 3 to Life years in the Utah State Prison.
COMMITMENT is to begin immediately.
To the IRON County Sheriff: The defendant is remanded to your custody for transportation to the Utah State Prison where the defendant will be confined11-29-2016
The charge carries a minimum mandatory sentence of 3 years to life in prison. Mr. Jackson argues for extended time before incarceration in order to obtain a psycho-sexual evaluation, and due to health and medication issues. Mr.Little argues for immediate incarceration for the victim's benefit and also because a PSI is not necessary in this case wherein there is a minimum mandatory sentence. He indicates that the Department of Corrections can perform evaluations.
The Court finds that an evaluation can be done after sentencing and during incarceration. The Court further finds that the Defendant should be taken into custody at this time. As to health issues, the Court is confident the jail's medical staff can manage Mr. Lyon's medical and diet issues. -

5. Cedar City man sentenced to 3 years to life in prison in child sex abuse case
CEDAR CITY — A 65-year-old Cedar City man has been sentenced to three years to life in prison for sexually abusing an underage girl.
Duane Lyon received the maximum sentence from Judge Keith Barnes on Tuesday after pleading guilty in November to one count of aggravated sexual abuse of a child. Nine other counts were dropped as part of a plea deal.
Several of the victim's family members testified in support of a merciful sentence for Lyon, who suffers from numerous medical conditions, the Spectrum reports.
Lyon's attorney, Bryan Jackson, argued earlier that any sentence could quickly become a death sentence because of the man's ailments.

7. Police: Cedar City man inappropriately touched child
A local construction contractor has been arrested on 10 counts of aggravated sexual abuse of a child, according to court records.
Duane Lyon, 54, of Cedar City was booked into the Iron County Correctional Facility on Saturday with bail set at $50,000.
According to the probable cause statement filed by the Cedar City Police Department, Lyons was arrested after allegedly touching the child, “over the clothing and they were both fully dressed during each of the incidents.”
During an interview with Lyons, the investigating officer stated, “Duane admitted to these allegations. He further described it as inappropriately touching the child,” the statement said.
The address on the booking information matches that of Duane Lyon Construction’s profile on the professional services website LinkedIn.
A search of the Utah Division of Occupational and Professional Licensing database shows Duane Lyon Construction, also with the same address, as having its contractor’s license expire in November of 2013.

10. Cedar City man sentenced in child sex abuse case
A Cedar City man accused of sexually abusing an underage female was sentenced to a maximum life sentence in the Utah State Prison Tuesday.
Duane Lyon, 65, pleaded guilty to one count of aggravated sexual abuse of a child as part of a plea deal in November. He was initially facing 10 total counts, but nine were dropped as part of a plea deal.

Duane Lyon, 65, pleaded guilty to one count of aggravated sexual abuse of a child as part of a plea deal in November. He was initially facing 10 total counts, but nine were dropped as part of a plea deal.
Following the recommendations of Adult Probation and Parole, Judge Keith Barnes sentenced the man to a minimum of three years to life in prison. He must also pay up to $25,000 in restitution on behalf of the victim to the Utah Office for Victims of Crime.
Family members of the victim came forward to express the desire for a just, but merciful sentence for the 65-year-old, who suffers from numerous medical conditions, including a heart arrhythmia.
“I would never want the darkest moments to define me my whole life,” a family member of the victim said. “ . . Duane has made mistakes, but we’ve all made mistakes.”
Walking to the podium to speak appeared to be incredibly difficult for Lyon as he needed the help of the bailiffs to get out of his chair and relied heavily on a cane.
Bryan Jackson, Lyon’s attorney, argued during a change of plea hearing in November that any sentence could quickly become a death sentence if his multiple medical concerns were not properly dealt with by the staff at the Iron County Correctional Facility or the prison.
Other family members, including the parents of the victim, asserted that Lyon had already received enough mercy when nine of the charges were dropped per the plea deal. Mercy had also been shown when earlier accusations of sexual molestation against other alleged victims were dealt with through a diversion program.
“Mercy needs to be shown, but what he’s taken away from her (the victim) can never be replaced,” the mother of the victim said.
Her father expressed a similar sentiment, adding the assault has been especially difficult for his daughter.

“Her trust for men is completely gone,” he said. “It is going to take a long time to fully recover, if ever.”
Lyon’s responses in the pre-sentence investigation report indicated that he had did not fully understand the gravity of his actions, according to Iron County Chief Deputy Attorney Troy Little.
But Lyon told Barnes he did feel remorse for the pain and trauma he caused his “little friend.”
“I took advantage of the situation and did poorly with it,” Lyon said. “I know that my mistakes have blown a hole through a lot of people and I’m sorry for that.”
Ultimately, whether his sentence lasts three years or the rest of his life will be up to the Utah Board of Pardons & Parole, Barnes said.
Lyon was arrested in September 2015 after he inappropriately touched an underage female “on several occasions” in the summer months of 2015, according to the statement of the defendant filed in the 5th District Court Tuesday.
The document also detailed that Lyon had a special position of trust in relation to the victim.
