February 2011 Darren John Haymond was a custodian at Provo High School in Provo Utah. He was arrested for taping his cell phone in a trash can inside the bathroom stall. A student found the phone and delivered it to the school administrators. Who discovered it was Darren Haymond’s phone. Haymond was fired, the police were called and Haymond arrested and charged. Haymond pleaded guilty to voyeurism, a class B misdemeanor. Darren Haymond was sentenced July 14, 2011.
The Judge in Haymond’s case said he could avoid his 60 day jail time if he completes treatment and pays a $750 fine.

1. Provo High custodian arrested in alleged voyeurism
PROVO — A high school custodian was arrested Wednesday for investigation of voyeurism.
Darren John Haymond, 23, of Salt Lake City, was arrested for allegedly hiding his cell phone in a bathroom stall and attempting to videotape or take pictures of girls.
The phone was discovered by a student who found it "concealed in a trash receptacle inside of the bathroom stall. The phone had pieces of trash on it in an attempt to conceal it. The phone was in a position to record an individual while using the bathroom," according to Provo police.

Darren John HaymondThe phone was found after school had ended for the day, about 3 p.m. The student, believing it was simply dropped by another student, took it to school administrators, said Provo School District spokesman Greg Hudnall.
As school officials started going through the phone to figure out who it belonged to, they were led to Haymond, Hudnall said.
Hudnall said the phone was discovered before any pictures of girls were taken.
But a statement from Provo police said that as a vice principal was going through the phone to figure out who it belonged to, he "observed video on the phone of two separate female students in a Provo High School bathroom stall. There was also video of the individual/suspect placing the phone in the trash receptacle."
A short time later, Haymod tried to report that his cell phone was lost or had been stolen.
Haymond was a part-time custodian at Provo High School. He had been there since 2009.
Police were called and Haymond was arrested and fired from his job. "Behavior like this will not be tolerated," Hudnall said.
He said this was the first time he could recall something like this happening at Provo High School. Hudnall also noted that criminal background checks are conducted on all employees prior to being hired.

3. Former Provo High janitor pleads guilty to voyeurism
PROVO — A former Provo High School janitor accused of placing a cellphone camera in a girl’s locker room pleaded guilty Thursday to reduced charges.
Darren John Haymond, 23, pleaded guilty to voyeurism, a class B misdemeanor, for hiding the camera in February. Prosecutors agreed to amend Haymond’s charge from a class A misdemeanor in exchange for the plea. Defense attorney Douglas Nielsen told the court that he and prosecutors also had worked out a joint sentencing recommendation as part of the plea bargain. However, Nielson did not elaborate on the details of the sentencing recommendation. Haymond will be sentenced on July 14.
Police reported that Haymond was arrested after a girl found the camera concealed in a trash can inside a bathroom stall. The girl reportedly took the phone and gave it to a vice principal, who allegedly discovered images of two girls as well as of Haymond placing the phone in the trash.
School authorities said after Haymond’s arrest that he was hired in September 2009 and had a complete police background check at the time. He was terminated as a result of the charges.
In May, Judge Derek Pullan took the unusual step of rejecting a plea bargain that would have changed Haymond’s charges from voyeurism to sexual battery, a class A misdemeanor. The deal would have given Haymond more opportunities to have his record expunged in the future, and would not necessarily have required him to register as a sex offender.
But Pullan said that there was no factual basis to support a sexual battery charge, and defense and prosecuting attorneys were sent back to the drawing board to draft a new deal.
After Haymond’s hearing Thursday, Nielsen said that he and prosecutors worked hard to craft an acceptable plea bargain. He also said that there are a number of mitigating factors in the case, including Haymond’s progress in treatment, his enrollment in school and his background. Nielsen added that Haymond accepts responsibility for what he did.
“He acknowledges that there’s a consequence for action,” Nielsen said.

4. Provo High custodian sentenced for restroom videos
A former Provo High School custodian will have to spend the next 30 days with an ankle monitor and undergo sex-offender treatment for trying to take videos of students in a girls' locker room.
Darren John Haymond, 23, was arrested in February after a student found a cell phone planted in a locker room restroom stall, officials said.
Haymond placed the phone in a garbage can and attempted to conceal it with trash, according to the Provo Police Department. The phone recorded two students in the restroom stall before it was spotted, police said.
Later that afternoon, Haymond went to school officials to report that his phone had been lost or stolen, police said.
Haymond pleaded guilty last month to voyeurism, a class A misdemeanor. As part of Haymond's sentencing, 4th District Judge Derek Pullan said Haymond would avoid spending 60 days in jail if he completes treatment and pays a $750 fine.
